<h2 class="wp-block-heading">How foreclosures work in Alberta</h2>



<p>In Alberta, foreclosure is governed by the Law of Property Act. Usually, once 2 to 3 months of payments have been missed the lending bank will submit a file to the foreclosure lawyer of their choosing. The first thing that lawyer will do is issue a&nbsp;<em>Demand Letter</em>&nbsp;to the borrower (you). This letter acts as a notification that you are in default of the terms of their mortgage. The Demand Letter usually gives 10 days to correct the problem. If the borrower is able&nbsp;to pay the outstanding arrears in full, plus a nominal legal cost, the foreclosure action is avoided. If payment is not made by the date specified, the lawyer is open to file a Statement of Claim with the Court. The Statement of Claim is the official beginning of a lawsuit by the Plaintiff (bank) against the Defendant (borrower).</p>



<h3 class="wp-block-heading">Statement of Claim</h3>



<p>The Statement of Claim outlays what breach has been committed under the terms of the mortgage and it also outlays what remedy the bank is looking for. Under Alberta law, it provides a 20 day grace period for the defendant to file a Statement of Defense.</p>



<p>After the Statement of Claim has been served, you will have a number of options on how to proceed. You may elect to sell your house, to pay up the arrears in full immediately, or to negotiate a payment plan with the lender, you may choose to consent to an Order for Sale to Plaintiff or an Order for Foreclosure in which case the lender takes over the property. All of these options have their advantages and their distinct drawbacks. Proper guidance is a must as decisions made now can greatly affect the ultimate outcome.</p>



<h3 class="wp-block-heading">Understanding the Statement of Defence</h3>



<p>Within a Statement of Defence, a borrower needs to provide legitimate reasons as to why the lender should not proceed in their action. It is important to understand that the law is not always compassionate to personal afflictions, regardless of how difficult or out of your hands they really were (ie: job loss, health issues,&nbsp;relationship breakdowns ect.). The law is used to interpret the facts based on the agreements made. Regarding mortgages, the fact is that you borrowed money and it has not been paid back as stipulated in the agreements signed.&nbsp;</p>



<p>The reality is that filing a Statement of Defense based on personal reasons of to why the mortgage wasn&#8217;t paid as stipulated is rarely a helpful step to a homeowner in foreclosure. In foreclosures, a Statement of Defence rarely proves to be successful, unless it involves cases where financial fraud against the lender can be proven. Again, this is a very rare occurrence.</p>

<h2 class="wp-block-heading"><strong>What is the loan to value ratio?</strong></h2>



<p style="text-align:left">The loan to value ratio, commonly referred to as “LTV”, is a financial term that compares the amount of a loan to the value of the asset securing the loan. For example, a person needs a mortgage renewal of $250,000 on a home that is appraised at $500,000. The&nbsp;<strong>LTV</strong>calculation would be ($250,000/$500,000)x100 =&nbsp;<strong>50%</strong>. &nbsp;This value is used to determine the amount of risk the lender would be taking in providing a mortgage.</p>

<p>As the LTV determines the amount of risk the lender would be exposed to, the lower your LTV ratio the better. At this time, most lenders will only approve a mortgage renewal that is well under 80% LTV. However, in some cases, the threshold for many lenders has dropped further to under 80%. Factors such as location, credit, and income are also being used to calculate LTV.</p>

<p>We have stated before that&nbsp;<a href="/bankruptcy-and-foreclosure/">bankruptcy will not solve a foreclosure</a>&nbsp;in Canada because secured debts such as mortgages are not allowed to be included in a bankruptcy in Canada. Bankruptcies can only apply to unsecured debts such as consumer debt, credit cards, and unsecured loans. However, where bankruptcy may come into play with the foreclosure process is after a foreclosure has been finalized and you are handed down a deficiency judgment by the court.<br></p>

<p>A deficiency judgment is a legal judgment against you for money owed beyond the value of the property that was foreclosed upon. If at all possible you will want to do everything you can to&nbsp;<a href="/overcoming-deficiency-judgements/">avoid having a deficiency judgment</a>&nbsp;against you as this would mean having to personally owe the bank a very large sum of money even after they have taken your home. However, deficiency judgments do happen, and in many cases, a deficiency judgment often leads to wage garnishment and/or personal bankruptcy.<br></p>

<p>There was a time where you could hand in your house keys to the bank in the event your mortgage was valued higher than the home and you could no longer afford the financial obligations of homeownership. In some circumstances and in some jurisdictions this still remains true, but we now live in a more complex world with increased rules and this practice has pretty much disappeared. For the most part, lenders understand that you may wish to have your house foreclosed on by them but they still push it through the court system, as a standard foreclosure would. Not knowing what position you are in can cost you thousands of dollars in extra legal fees and reduced home value.&nbsp;</p>

<p>Stopping a foreclosure involves much more than just throwing money at the problem. Knowing who to pay, how much to pay, and when to pay are three important questions to consider.</p>

<p>We have seen it happen far too many times where a person facing foreclosure panics and cobbles together all their current resources in a vain attempt to pay the arrears and get back on track with their lender. The amount is substantial to them but it still does not equal the total the lender is asking for. The owner deposits the money with the lender&#8217;s lawyer under the impression their foreclosure will cease, or at least they will get more time to pay the balance of arrears. Unknown to the owner is the fact there is a pecking order as to how the money is applied in a foreclosure. Arrears payments are first applied to legal fees, then to any municipal tax owing, then to condo arrears, etc. Whatever is left over at the end is then applied to the mortgage balance. Despite the initial large payment, the foreclosure continues as there are still arrears owing on the mortgage.<br></p>



<p>The important point here is that an owner must have a solid and forward thinking plan when dealing with a foreclosure. What is the point in paying a partial amount on the arrears, only to get foreclosed out and perhaps not have enough funds to pay the first month of rent and security deposit on a new location? Unless an owner can source the full amount of the arrears, including all legal fees, within a set time frame, they would be better to hold that money on the side and work to save the balance of payment.<br></p>



<p>Never deposit money to a foreclosing law office without a signed, bank accepted agreement. Please&nbsp;<a href="https://abforeclosurestoppers.ca/#contact">contact us</a>&nbsp;if you need assistance with submitting a formal proposal to your lender’s lawyer. There is specific wording and additional documents you are required to provide in order to have the best shot at lender acceptance of your proposal. You often only have&nbsp;<em>one shot</em>&nbsp;a lender acceptance, so it is very important to have a well thought out plan.&nbsp;</p>

<p>We have noticed a trend lately with more people allowing their home insurance to lapse when faced with financial hardship. It seems like a logical choice to make. If you are having a tough time putting food on the table then you need to cut costs somewhere &#8211; and a faceless insurance company seems like a good place to start. Where it gets complicated is that home insurance coverage is a requirement of most lending banks. If a homeowner cancels home insurance it is a default under the mortgage and the lender can then call the loan due. A foreclosure action then begins. The fact of the matter is that it is&nbsp;<strong>NEVER</strong>&nbsp;advisable to cancel your home insurance for any reason, and here is why:</p>



<ol class="wp-block-list"><li><strong>Cancelling your insurance can result in foreclosure</strong></li></ol>



<p>Most mortgages have a provision that requires the borrower to maintain adequate home insurance. Your home insurance not only protects your primary asset but it also protects the bank’s asset. &nbsp;When a bank lends you money in the form of a mortgage it is an asset to the bank. You pay them monthly for the right to use that money. Their asset must be protected. If your home burns down their asset (mortgage) is at risk of not being paid back unless there is adequate insurance protection in place. The primary reason they want you to have insurance is for their protection, not yours. You will find this requirement outlined in the fine print your original mortgage agreement.</p>



<ol class="wp-block-list"><li><strong>Makes it harder to work with the bank while in foreclosure.</strong></li></ol>



<p>If you are in foreclosure a cancellation of insurance makes it harder for you to work with the bank to correct the default. We often submit formal payment plans to lenders on behalf of clients in foreclosure. One of the key provisions within those plans is that the homeowner must prove they are current on their homeowner insurance policy. The bank will not even consider a payment plan if no insurance policy is in place.</p>



<ol class="wp-block-list"><li><strong>Opens you up to liability if there is an incident.</strong></li></ol>



<p>Without proper insurance, you have a higher risk of loss if something destructive occurs to the property, if someone is injured on the property, or any other type of incident happens to which you are liable for. Replacing a home due to a fire or, having to combat a lawsuit for personal liability can cost well into the hundreds of thousands of dollars. Having insurance is the most basic way to prevent a severe financial blow.</p>



<ol class="wp-block-list"><li><strong>It makes it VERY difficult for you to obtain insurance in the future.</strong></li></ol>



<p>This is probably the most important point that is overlooked by many homeowners. If you cancel your home insurance, have a lapse in payments, or have your insurance cancelled on you, it can be extremely difficult to obtain insurance from any insurer at a later date. Having a cancellation in your insurance history is black mark on your permanent record. Insurers see you as unreliable, and most will choose not to do business with you. A future insurer will see this lapse and inquire about the nature of the gap in insurance. The end result is your insurance premiums are likely to be much higher with the new insurer &#8211; if you can even find one. Any new insurer will also likely force you to pay up front for the entire year, as opposed to a monthly plan.</p>
